Some Alaska Marijuana Businesses Receive ‘Cease And Desist’ Orders To Shut Down Or Else


cease and desist marijuanaThere have been underground medical marijuana outlets and clubs for awhile now in Alaska. Alaska is like most other medical marijuana states where such entities existed, operating in what some describe as a ‘grey area’ of the law, while others call it a blatant disregard for the law. Now that recreational marijuana has been legalized in Alaska, some Alaska marijuana establishments have received ‘cease and desist’ orders demanding that they halt operations until marijuana business licenses are issued. Per the Frontiersman:

Two local marijuana-related businesses were among six that received cease-and-desist orders from the state this week.

Northern Heights LLC, a “cannabis-friendly” hookah lounge, and Discreet Deliveries, a business offering marijuana for sale and delivery, both based in the Mat-Su Borough along Bogard Road, joined businesses from Kenai and Anchorage on the list. The certified letters mailed to property owners were a follow-up to phone conversations on the subject, which alleged both businesses violated Alaska statute, according to the letters.

The cease-and-desist letters threatened “enforcement action” ranging “from criminal penalties to civil fines, tax penalties and prohibition from receiving an actual marijuana license when they become available in 2016,” the letter states.

What’s happening in Alaska is not uncommon. I have seen the same thing happen in Oregon, and have heard of it happening in Washington, Michigan, and many other states. On one hand I don’t think that marijuana sales should be prohibited, but on the other hand I am always hesitant when I see people jumping the gun and starting sales before regulations and licenses are in place. I don’t ever want to tell someone that they can’t sell marijuana, especially to patients, but they run a lot of risk in doing so. Hopefully licenses get issued sooner than later and this whole potential showdown ends.

    Welcome to (fake) ‘legalization….pre “legalization” in 2010 there were over 66,000 voluntarily registered caregivers in CO. post “legalization” 2015 there are less than 4,000….health dept and cops threatening and shutting down (illegally) everyone who is constitutionally protected as MMJ….they want more tax.

  5. I agree with you Johnny. It’s a tough thing when people are operating in the grey area of the law. You generally see this happen at the very beginning of a Medical Marijuana law in a State. There are certain people who operate their lives in the grey area. These people are willing to put EVERYTHING they have at risk (family, business, FREEDOM, etc…) to make a LOT of money doing it for about the first 3 years of a programs inception. It’s NOT something I would do personally. But without those people, an unbelievable amount of people would be going without medicine!

  6. With this whole weed “legalization” (still against your federal laws, sorry!) going on in BurgerLand (no offense, I like hamburgers), I keep hearing about Colorado, Washington, DC and Oregon. But never anything about Alaska. They legalized weed? Seriously? What person in their right mind would want to live in that extreme cold?

    The more stories I hear from Cancer patients about their experiences with Medical Marijuana, the more concerned I become that Medical Marijuana isn’t available in all 50 states on the same basis as every other medication. Medical Marijuana is a “Gift from God” for America’s Cancer patients, for American kids with seizure disorders and for so many other sick, suffering and/or dying Americans. Its IMMORAL to leave Medical Marijuana on Schedule 1 for even one second longer.
