California Medical Association Endorses Marijuana Legalization Initiative


california medical association mariuanaToday, the California Medical Association (CMA) – representing more than 41,000 physician members statewide — announced its formal endorsement of the ballot measure known as the Control, Regulate and Tax Adult Use of Marijuana Act.

Consistent with the organization’s historic White Paper of 2011 (https://www.cmanet.org/news/detail?article=cma-urges-legalization-and-regulation-of) urging legalization and regulation of cannabis to allow for greater clinical research, oversight, accountability and quality control, CMA has endorsed the Adult Use of Marijuana Act so:

  • First, the impacts of marijuana in California can be monitored, researched, tightly regulated and, where necessary, mitigated to protect the public health &
  • Second, improper diversion by non-symptomatic patients into California’s medical marijuana system can be reduced.

In addition, CMA does not as a matter of policy encourage the use of marijuana and discourages smoking.  But, ultimately, its members believe that the most effective way to protect the public health is to tightly control, track and regulate marijuana and to comprehensively research and educate the public on its health impacts, not through ineffective prohibition.

“The California Medical Association believes the Adult Use of Marijuana Act is a comprehensive and thoughtfully constructed measure that will allow state officials to better protect public health by clarifying the role of physicians, controlling and regulating marijuana use by responsible adults and keeping it out of the hands of children,” said Steven Larson, MD, MPH, President of California Medical Association.

“Medical marijuana should be strictly regulated like medicine to ensure safe and appropriate use by patients with legitimate health conditions and adult-use marijuana should be regulated like alcohol.  This measure – along with the recently-passed medical marijuana bills — will ensure the State of California does both – while keeping the public health and public interest as paramount concerns,” Larson continued.

The Adult Use of Marijuana Act is a consensus measure based on recognized best practices and recommendations from engaged citizens and organizations representing local government, health and policy experts, environmental leaders, small farmers and business owners, worker representatives and social justice advocates.

It includes safeguards for children, workers, local governments and small businesses and strict anti-monopoly provisions and the toughest warning label and marketing-to-kids laws in the nation.

It provides hundreds of millions of dollars in annual funding — the highest level ever by any state in America — for youth drug prevention, education and treatment programs.  It also provides significant investment into local law enforcement and environmental and water protection programs.

It also closely adheres to the Lieutenant Governor’s Blue Ribbon Commission on Marijuana Policy and the new medical marijuana laws recently passed by a bipartisan majority of the Legislature and signed by Governor Brown (SB 643, AB 266 and AB 243).

The CMA won’t flip flop on this endorsement, more and more well known and respected coalitions like the CMA are waking up and realizing that marijuana prohibition has failed, and what the 4 legal states are doing is a better approach.

Picking nits? Anyways the endorsement in a credible achievement given the weight of 41,000 members of the medical community. Is it beyond hope that the California District Attorneys Association along with The League of Cities and Police Chiefs get on board? For unless they do, where I live there are total bans. Complete, right down to home cultivation for medical patients. Because of the recommendations by staff that were influenced by LOC and CPCA, the city council, like the majority of cities in Ca., have followed suit and banned. Sciency words aint gonna get through to muni’s that fund themselves through prohibition. My city PD bought a third Helio with drug forfeiture cash. Cold turkey is not what they will settle for.Council members will break out in tongues, and on cue pre selected audience members will swoon vapers.

  3. California doesn’t have a “per se” DUI-D law, like other states, and AUMA doesn’t change that; they still have to prove impairment, regardless of how your blood test comes back.

  4. See if you can get into clinical trials of THC eye drops. Using it topically will enable you to reduce your eye pressure more effectively.

  6. The bottom line is that Marijuana is, in the words of Dr. Sanjay Gupta “not only good medicine, its often the only medicine that works”, and when used socially by adults, is a far better and safer alternative to Alcohol.
    People working to change Marijuana laws have the truth on their side.
    People who are trying to hold back progress on this incredibly important issue are doomed to fail, because the truth always wins in the end.

  7. While it’s important to have these organizations backing initiatives, what impact will it have for those of us living in and surrounded by cities who have engaged in the banapalooza? Every city around me, including the one I live in has rushed to ban cannabis because of the recent laws passed by Brown.

    Like many other patients, I rely on a dispensary to provide medicine. The bans are only serving to grow the black market and have the opposite effect that cities desire. My city is trying to come out of bankruptcy and still won’t allow the ‘evil reefer’ in.

    I am a medical marijuana patient with glaucoma and my ophthalmologist advises that marijuana is efficacious for glaucoma.

    Under current rules I can home grow up to 12 immature or 6 mature plants and that is per person not per household. I am retired on fixed income and can’t be paying high store prices.

    I also have concerns with THC testing of drivers. Will I test positive the following day even though I’m not high? Who has or will calibrate the degree of impairment? Interested to see tests on driving a slalom course next day or even with varying degrees of high. I bet that won’t happen and that police will just use some simple but totally inaccurate blood test.

    Looks like I’ll be better off without legalization and will VOTE NO.
