DA Prosecutes Elderly, Sick MMJ Couple In Court

Dennis and Deborah Little are residents of rural Ramona, California. They are both in their sixties. Both suffer from debilitating and chronic illnesses one of which is terminal. Dennis Little is a qualified medical marijuana patient who grew his own medicine in their backyard. He believed his actions were lawful under the Compassionate Use Act which legalized medical marijuana in 1996. Unfortunately for the Littles, the DEA and San Diego Sheriff’s Department have refused to acknowledge the Littles’ rights under state law.

During the months of September and October of 2012, San Diego Sheriff’s Department helicopters patrolled the rural parts of San Diego County in conjunction with the DEA’s “marijuana eradication” efforts. A Sheriff’s Deputy spotted Mr. Little’s marijuana garden from the air and immediately filed for a search warrant to raid the property. No law enforcement ever contacted the Littles to ask if they were medical marijuana patients. Instead, on October 17, 2012 at approximately 5:30 a.m in the morning, a small army of DEA agents descended on the Littles’ property to execute the warrant. Despite their poor health, the Littles were handcuffed and subjected to police interrogation techniques. After several hours of investigation, the police dug up and destroyed all of their marijuana plants.

On November 27, 2012, District Attorney Bonnie Dumanis filed felony criminal charges against Mr. and Mrs. Little. Denied the medicine that provides them relief, the Littles must now fight a criminal prosecution for exercising their rights under California State law.

    I don’t see where they list items confiscatedin the raid? Did the department not seize any personal property or has this prctice stopped?

    District Attorney Bonnie Dumanis — Seems to be a the heart of almost EVERYTHING i read about the trampling of the rights of patients in Southern California. A shame that this is still floating around, unflushed in the bowl.

  3. This really DOES need to stop Sharon!! I live in CT., we passed decriminalization of small amounts of Marijuana. I think it’s anything less than a 1/2 oz is a ticket. CT also passed a Medical Marijuana Law, but nothing has even started yet. They still have to hammer out the laws surrounding it and set up growers, clinics, etc, etc, etc. All the while we who use it for medical conditions like the Little’s have to suffer and feel like criminals. Just look at the Little’s for crying out loud, here they are minding their own business, legally growing their plants/medication and these gun-ho green beret wanna be’s come in with full gear and automatic refiles at the ready. It’s a miracle they didn’t have a heart attack over this. Now they have to suffer without their meds, unless they let Mr. Little keep his medical marijuana card, which I doubt.

    I don’t care if I get caught, I only keep what the law thinks is enough for one person to have. And if I have to pay a ticket, then I will. Until this state gets all their “ducks in a row”, maybe our clinics will be opening soon!! They, the law makers, are really dragging their feet on this one. You legalize medical marijuana use, but have no idea how to operate it lawfully. I’m wondering what they are smoking, lol, lol!!!

    I wish the Little’s luck and maybe some restitution for what the law took too!!!

  9. The Little’s need to allow the trial to go forward (with a public defender or pro bono lawyer). The feds will have to convince a jury that they were justified in their actions against the Littles.

    Their only hope is to have the jury refuse to come to a verdict. The jury can state that the law is unjust and harmful to those in need of an inexpensive safe medicine for the Littles illnesses; or any other reason.

    The jury must understand that California MMJ law was enacted by the majority of the people within the state and represents the will of the people; the federal law was a law enacted by congress. Members of the republic should not be punished by the federal government for acts that the majority of the people currently support. The federal law (cannabis prohibition) is an outdated law that no longer reflects the will of the majority and based upon this members of the jury can subvert federal cases against legal MMJ patients (over 70% now support MMJ laws in California). If 70% of the jury supports MMJ then the feds cannot convict.

    I other words the jury has the ability to undermine federal trial cases in many different ways. The jury can hijack federal cannabis cases (hung jury, jury nullification, reasonable doubt) making it difficult for the DEA and DOJ to prosecute their draconian law. Make it difficult for the feds to convict a MMJ arrest, go to a jury trial of your peers and put your faith in the people (dispensary owners – follow Harborside’s lead) and they will stop harassing law abiding MMJ patients and businesses.

    P.S. San Diego is a city of military bases and defense contractors with over 15,000 businesses relying on federal defense contract money. The city of San Diego needs to support the defense contractor industry (work closely with the feds) or they may lose tax revenue if the feds contract elsewhere. The defense industry is a world unto themselves, inhabited by other worldly people (an industry that manufactures a means to kill others)…

  11. Listen.. We need to stop worrying about the president and focus on term limits in all branches of the government. Also re-add the ability to lower the pay of the president and all government workers.

  12. Until WE as citizens DEMAND that it stop, and hold even our OWN politicians accountable for backing such actions… It will NEVER STOP! These pot politicians are addicted to the money they receive for marijuana eradication. I mean wr spend $50 BILLION a year to eradicate marijuana in this country, when for the first time in history the MAJORITY of Americans (58%) feel it should be LEGALanyway… They just can’t see how we can FISCALLY incarcerate so many NON-VIOLENT drug offenders yet we can’t afford to allow US citizens to tour The White House!

  13. my heart goes out to this couple how does any gov legitamise these actions against a elderly couple that have contributed to their country for decades ,sadly these barbaric acts are caried out daily the world over , in the name of us the people , change must come fight da fight …peace
