Idiot Congressman From TX Holds Up Federal Marijuana Legalization Effort

Lamar Smith

By Steve Elliott of Toke of the Town

What’s that? You’re excited about the Ending Federal Marijuana Prohibition Act, are you? You’re invigorated by the idea of saving millions of taxpayer dollars, and finally putting law enforcement priorities where they belong?

Maybe you’re pumped about the possibility the these United States could finally end the 74-year-old nightmare of cannabis prohibition, and stop putting people in cages for growing and using a demonstrably harmless plant?

Well, simmer down, weed lover. It seems that the opinion of one good-old-boy Congressman from Texas outweighs yours.

Rep. Lamar Smith (R-Texas), also known for his anti-immigrant policies, has said his House Judiciary panel will not consider the Barney Frank/Ron Paul bill. Period.

Smith’s opposition to sane marijuana policies shouldn’t come as any surprise. After all, back in 2009 when the Obama Administration announced it would no longer prioritize going after medical marijuana patients and providers in states where it is legal, Smith was against that, too, stridently calling for the Justice Department to “enforce federal marijuana laws.”

“By directing federal law enforcement officers to ignore federal drug laws, the Administration is tacitly condoning the use of marijuana in the U.S.,” Lamar said at the time. “If we want to win the war on drugs, federal prosecutors have a responsibility to investigate and prosecute all medical marijuana dispensaries [italics added]and not just those that are merely fronts for illegal marijuana distribution.”

Apparently in Lamar Smith’s ugly little redneck world, it’s not OK even for seriously ill patients to smoke that marry-ju-wanna stuff.

marijuana“Decriminalizing marijuana will only lead to millions more Americans becoming addicted to drugs and greater profits for drug cartels who fund violence along the U.S.-Mexico boarder,” Smith said. “Allowing states to determine their own marijuana policy flies in the face of Supreme Court precedent.”

Smith’s statement ignores the facts from countries like Portugal and the Netherlands which have relaxed their cannabis laws, only to see usage go down, in the general populace and especially among youth.

And the cowboy Congressman also conveniently ignores history. After alcohol Prohibition was repealed, are the bootlegging gangsters the ones who reaped the profits in a regulated system? Of course not, and the drug cartels wouldn’t be reaping profits from legal pot, either.

Just to make a clean sweep of it and make his statement entirely fact-free, Smith was also wrong about the Supreme Court, which has never held that the Constitution requires Congress to criminalize cannabis.

As pointed out on the excellent blog Absurd Results, “Smith has the Constitutional issue exactly backwards.” Because a Constitutional amendment was required to outlaw alcohol, it follows that Congress is currently violating the Constitution by criminalizing marijuana without an amendment expressly granting the federal government that power, the current Supreme Court’s insane interpretation of the Commerce Clause notwithstanding.

Now, we all know that this half-wit Texan already has his mind made up, so maybe there’s not much we can do about that. HOWEVER. What we CAN do is to make every single day of the rest of his life an occasion upon which he was reminded of his rank stupidity.

Here’s Rep. Lamar Smith’s contact info. Let him know what you think of the fact that he is now, by his own choice, the man responsible for continuing marijuana prohibition in the United States.

You can get started by emailing Lamar (click here), but this “man of the people’s” website makes you put in your zip code to do so (handy way to reduce citizen input), so you’re going to need to be from the 21st Congressional District of Texas to do that.

  1. We should be marching to Washington as one nation and demanding the changes we deserve, this government is no longer in the hands of the people but the pockets of the corporations.

  2. Here is some fuel for the fire:

2306 which would allow states to decide for themselves is being
blocked by Rep Lamar Smith (R) of Texas. This is a man who in the
current cycle has taken money for his campaign from:
$20,000 : National Beer Wholesalers Assn.
    $15,000 : Schering-Plough Corp (merged with MERCK)
$11,000 : Altria Group (formerly Philip Morris)
$10,500 : Wine & Spirits Wholesalers of America
$8,000 : Eli Lilly & Co (prozac + cancer drugs)
    $8,000 : Amgen Inc ( drugs for dealing/w chemo )
$7,000 : National Community Pharmacists Assn
    $5,000 : GlaxoSmithKline
    $5,000 : Constellation Brands (Beer&Wine (B&W))
    $4,800 : Republic National Distributing (B&W).
    (according to http://www.opensecrets.org/pol

This is the same man who says he will not even consider allowing it
to pass and is the head of the committee. Surely you can see the
conflict of interests when marijuana is proven to lower consumption use
of tobacco and alcohol- while offering a plethora of medical benefits.

According the US Department of Justice National Drug Intelligence
Center- issued a report entitled “The Economic Impact of Illicit Drug
Use on American Society” Which said in 2007 we lost $193,000,000,000.00
fighting a war on drugs on a state and federal level. That is JUST ONE
YEAR. No wonder the DEA who so strongly opposes marijuana continues to
try to play the American public as fools. Marijuana accounts for 49%
of all arrests and according to the report near 150 billion goes to
    police/courts/prisons fighting drugs.

  3. Marijuana is about as addictive as cheese. Speaking of which, time for me to case the dairy farm.

When will politicians start using big words again that can confuse the normal population? Maybe that’s when I’ll start respecting those liars, because if they use big words, they must be educated.

  4. ConservativeChristian.

You touched another fair sensitive subject. People that go to prison, can deal with horrible circumstances, that’s just evil. This has no excuse, this man is as much a criminal as a rapist. He has been raping and allowing others to rape and ravage our country while our countries women and daughter and fathers n sons and brothers have cried for mercy and help.

its like a living nightmare… i hope more people have courage to step up and do the right thing… i for many am not conforming to this evil situation. I have been working long and hard on a Peace and Non Violence department for our country. The time is now.

  5. conservative Christian below pointed out a few of the ‘beer’ sponsors he has, another important thing I left out, he is also in with the private prison syndicates, so he’s making even more money for people he gets into their prison systems!!! Wether through immigrant issues (he then keeps them there indefinitely charging tax money to tax payers while these immigrants do not know jack about law or lawyers so they are keeps for long portions of time at the expense of hard working American Families or residents etc that do pay taxes

Thanks to you all our boats still floating if not this false alqaeda system would of sunken our ship a while ago as they intended with the false 911)… or wether through marijuana issues. And then the DEA BURNS UP or as they say INCINERATES $200,000,000,000 (yes 2 BILLION DOLLARS) worth of marijuana over 2 week spans (noted through a CBS video report/news report aired on TV and available online) , this is just the can of worms many Americans have been dreaming of opening to fix our Country and save the world. Globalization can not go on without this.

  6. Ahmad, I believe if you read through the report and comments, you will see it was through corruption. If you want step by steps, then good luck, it’s called covert discreet corruption, that is being slowly reverse engineered by ‘THE PEOPLE’, thanks to technology and the speed of intelligense and evolution. Many people might be askin what you asked though, I say half the battle of The War on Drugs has been won, from within The US, by US THE PEOPLE OF THE USA. However, we still need to beat those that are sustaining the false failed war on drugs. MANY are not just suffering, BUT DYINGGGGGGGGGG FREAKIN DYINNGGGGGG.. because these bigots want to keep accepting money under the table and etc…. AUDIT THIS SCUMBAG and follow his every moves people. I bet you he has money over sees and or invested in commodities and even with companies that support his “role playing”, like big tobacco and big alcohol and big pharma, even MONSANTO.

  7. ConservativeChristian on

Jesus said to do unto others as we would have them to do unto us. None of us would want our child thrown in jail with the sexual predators over marijuana. None of us would want to see an older family member’s home confiscated and sold by the police for growing a couple of marijuana plants for their aches and pains. It’s time to stop putting our own family members in jail over marijuana.

The current proposal before Congress, bill HR 2306, will remove marijuana from the list of federally controlled substances while allowing states to decide how they will regulate it. Email your Congressperson and Senators at http://www.usa.gov/Contact/Elected.shtml and ask them to sign on as a CO-SPONSOR of HR 2306.

For more info, here’s the USA Today article

And a big THANK YOU to the courageous, freedom-loving legislators, governors, and countless others who are working so hard to bring this through! You’re doing a great service for all of America!

Judiciary committee chair Lamar Smith / Texas against the bill; here are some of his campaign finances http://www.opensecrets.org/politicians/contrib.php?type=C&cid=N00001811&newMem=N&cycle=2010

Note the THOUSANDS of dollars from the National Beer Wholesalers.

Here’s a list of other National Beer Wholesalers Assn contributions http://www.opensecrets.org/orgs/totals.php?cycle=2010&id=D000000101

Note also: $2,000 funding from Corrections Corporation, the largest for-profit prison company in America (they want to keep marijuana illegal because it keeps their prisons full and keeps them getting rich) http://www.opensecrets.org/pacs/pacgot.php?cmte=C00366468&cycle=2010

Is Mr. Smith trying to protect Americans, or just his campaign financiers?

  9. Because a Constitutional amendment was required to outlaw alcohol, it follows that Congress is currently violating the Constitution by criminalizing marijuana without an amendment expressly granting the federal government that power, the current Supreme Court’s insane interpretation of the Commerce Clause notwithstanding.

Can someone explain how the Government got away with a law that is Anti-Constitutional?

  10. I don’t think one can with 100% confidence say Mr. Smith is an “idiot” concerning his decision to block the cannabis bill, since he does get lots of money from those with vested interests in keeping hemp illegal. And please don’t just think away this issue, call Mr. Smith’s office like I did and tell them that Communist Smith should stop the War on Drugs and move that cannabis (‘marijuana’ actually started as a racist term) bill forward, otherwise the innocent blood shed by this immoral war is on his hands. I, as a former Communist in the push for the War on Drugs, didn’t realize I was a Communist, since I never thought out thoroughly what Government and Law are meant for. Our Constitution is a bunch of negative liberties against the government to keep it in check so that they do not trample on our YHWH-given rights of freedom of Religion and freedom of speech. Mr Smith and other Communist of the War on Drugs make outlaws out of otherwise law-abiding people, all the while taking money from those with a vested interest in keeping hemp illegal. This is the definition of corruption – malfeasance in government – and what I consider Communism by a Communist. Those jack-booted officers bust down your door for politicians to the twisting of our Constitution by people of warped, twisted minds who think their self-righteous indignation against these illegal drugs somehow gives them the right to trample our YHWH-given rights in favor of their evil, blood-dripping policies of destruction and lawlessness that have wreaked havoc on every city in American and even all throughout the enire world. Thanks for listening, 777denny

  11. Reverend Unruh on

This is a great article, thanks. I called his office and left a message with the clerk. I told him I wanted my freedom of religion. I hope the congressman is familiar with this law,

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

Because I think I not only deserve my freedom of religion, I think I’m going to get it. I don’t think he is going to stop me, so I told his clerk that. I also mentioned my minister in Hawaii who has been held without bail for almost a year, Roger Christie, http://www.thc-ministry.org/ I really don’t like that kind of discrimination against us, not one little bit.

  15. Lamar is a prefect example of what is wrong with our federal government. You are not going to change anything with reason. They hate reason because it exposes them as the traitors that they are. We are headed for a second American revolution, and I don’t see any thing that can stop it. Paul, and Frank are good men but they are drowning is a sea of shit in Washington DC.

  16. Rep. Lamar smith has just sealed the end of his political carrier, as mom was a San Antonian and though deceased their are sufficient family members spread throughout his district of Texas. He is only in Office for two years at a time and so he can be gotten to by voters to remove him from Office next election, so let’s all get to work and contact all your Texas friends and should you not have any start making some so you can educate them, to vote him out. I must state though that calling him names does no one any good. So keep your temper checked and let’s get this guys and his carrier politician position emptied and filled by someone else. Here another Idea for us all. Let us start working Facebook and Tweeter and such to get to the Texas voter to vote him out in his next up and coming election period and through his Butt out of his office.

  17. I just tried to contact him and it said their servers are experiencing difficulties. This means people are obviously sending him tons of messages! Everyone keep going!

  18. wow, he must be really concerned about his buddies in the cartels. I suppose when we can pay him more for Justice then the cartels can pay him for Corruption he might change his mind. This man is in bed with the mexican cartels and for those that think otherwise need to pay attention, if legalized the flow of money south would putter-out over night. so good job people electing the corrupt RIGHTWINGED nut-jobs like this loser. Lamar, yes even you will have to answer to God. goodluck with that one buddy

  19. I’ve been more serious, googlemaps, the interactive map on his website, and finally texan yellowpages:

  20. Help the bill pass – Sign the petition to “Change the Schedule of Cannabis, Cannabis Laws, and Drug Czar Laws”.

Read and sign the petition at

Each signature sends an email petition letter to both Senators and the House Representative of the signer. After you sign send an email invite, share on facebook or twitter from the petition page.

Be sure your Representatives know you want change!

Then sign every petition you can find – good place for that is http://activistcat.com/
they have petitions from everywhere in one place. Great vids and info too.

  21. I used Hudson Bend, Tx 78734-1451.
Everyone needs to call or write and educate this man!
Most of the other Judiciary Committee should also be contacted, especially those from states without medicinal use.
You can find them here –> http://judiciary.house.gov/about/members.html
Write one educating letter and send it to each.
Check out their district, use an address and zip from that district so they open it.
maps.google.com and http://zip4.usps.com/zip4/welcome.jsp for zip codes.
Time to end this war, we all must take part!
For an effective letter – stick to the points, do not get angry, or insulting, be convincing.

  22. When it asks you for zip code info. In the first box I used 78209 and the second I used 0001. :D
