Marijuana ‘Open Container’ Law Is Now In Effect In Washington State

Washington State has a new ‘open container’ law directed at marijuana. Washington already had an open container law for alcohol, and now the same theory applies to marijuana. If you have marijuana in your car, it better be in an unopened container from a licensed store, otherwise you get fined. Per King 5:

Washington State troopers are ramping up efforts to enforce a new portion of the state’s marijuana law, which makes it illegal to have an open container of pot in your car.

The law went into affect on Sept. 26 and is similar to the state’s alcohol open container law.

The law states that marijuana must be in its original sealed package and stored in the trunk of your car or behind the backseat. It also extends to pot-infused edibles.

The fine for a violation is $136. This means that not only can you not have an open container from a store in your vehicle, but you basically can’t have any black market marijuana in your vehicle at all because obviously it didn’t come with sealed packaging from a store. Washington residents cannot grow their own, so by default if marijuana is in your car without a store container around, it will be assumed that it came from the black market. The one exception would be medical cannabis that comes from a dispensary. I’m not sure how that works into the equation. I’m curious to see if law enforcement in Washington tries to use this new law to try to find angles. I guess only time will tell.

  5. My understanding was a person with a med card in Washington can grow fifteen plants. Am I wrong if so oops. I don’t know how I could get this sealed as they want to see. Maybe you are right Marcine just have not seen bags that seal with a lighter. I also want to follow the law to the best of my knowledge.

  6. If you buy an eight but just want to take a joint to a friend’s house to enjoy legally, you are breaking the law driving from a to b. How can you reseal a container once it is open?

  7. Heat seal, with a lighter, for instance. Unopened seal doesn’t require a fancy store label.

  8. This won’t stand. Marijuana is not alcohol. The preponderance of the research shows marijuana consumption is NOT a significant cause of auto accidents.

    In February, the Drug and Alcohol Crash Risk report, produced by the Department of Transportation’s National Highway Traffic Safety Administration, found that while drunken driving dramatically increased the risk of getting into an accident, there was no evidence that using marijuana heightened that risk. In fact, after adjusting for age, gender, race and alcohol use, the report found that stoned drivers were no more likely to crash than drivers who were not intoxicated at all.

    Further, this would work harm on low-income consumers. They need to buy in fairly large quantity to get discounts they can afford. – So if they are traveling, why shouldn’t they be able to take an open bag with them?

    What possible harm could it cause? – None.

  10. there is still time to get ‘home grow’ on most ballots before 2016 deadline of jan-feb depending on state.

    I’m not talking state wide, I am talking township, village, city, county, district levels. The smallest levels are the easiest.

    You would be surprised, in low population counties it will only take a couple hundred signatures to get it on the ballot.

    Start local and work your way up, it’s a lot easier.

    As I see it don’t draw attention to yourself while driving. And don’t make it easy to find in your car.

  12. It ain’t right as long as we can’t grow our own. We need to fight till the very end to restore that liberty. The greedy just gotta have their fingers in the pie!

  13. I’m trying to figure out how this would work… A pipe or bag is a bit easier to hide than a beer can or vodka bottle so a real search with dogs would be required. Can smell be a probable cause? What if a driver swerves… is it like: “may I search your car or do you want to wait for the dogs?” What if its a vaporizer? Illegal yes but how would they smell it. Logically I would hope that the law was meant to discourage toking while driving down the road.

  14. What if you do what I do and take it OUT of that bullshit packaging and do what is recommended, to keep your medication fresh. Put it in a jar! I’d be FUCKED too!

    They’re just doing this at the beginning of this law to make sure citizens KNOW they can’t have open containers in there cars. Once the people understand the law, it SHOULDN’T be a problem.

    Since they can’t grow their own, they can’t even make their own edibles. So, once again I-502 comes back to bite the citizens in the ASS!
